Terms & Conditions of Employment

(Applicable to Local & International Applicants)
By submitting your job application and/or accepting any offer of employment (whether written, verbal, or implied) from KNW Technology Consulting Sdn Bhd (“the Company”, “we”, “us”), you unconditionally agree to be bound by the following Terms & Conditions:
1. Application Process & Accuracy of Information
1.1 You warrant that all information provided in your application, CV, interviews, and any supporting documents is true, accurate, and complete.
1.2 Any misrepresentation, omission, or falsification (including forged certificates) will result in immediate withdrawal of the application or, if discovered after employment, summary termination without notice or compensation.
2. Pre-Employment Checks
2.1 All offers of employment are conditional upon:
(a) Satisfactory background and reference checks
(b) Verification of academic and professional qualifications
(c) Medical fitness (if required for the role)
(d) For international applicants: valid work permit/employment pass under Malaysian law
(e) KYC (Know Your Customer) verification where applicable
2.2 You agree to provide all requested documents within the stipulated timeline. Failure to do so will render the offer void.
3. Probationary Period
3.1 All new hires (local and international) will undergo a probationary period of six (6) months from the commencement date.
3.2 During probation, either party may terminate employment by giving one (1) week written notice or payment in lieu.
3.3 Confirmation of employment is subject to satisfactory performance and conduct.
4. Employment Contract & Governing Law
4.1 Upon confirmation, you will be issued a formal Employment Contract governed by the laws of Malaysia.
4.2 In the event of any conflict between these Terms & Conditions and the final Employment Contract, the Employment Contract shall prevail.
5. Remuneration & Benefits
5.1 Salary, allowances, bonuses, and benefits will be stated clearly in the offer letter and final contract.
5.2 The Company reserves the right to revise benefits from time to time with reasonable notice.
6. Statutory Contributions (Malaysia)
6.1 For Malaysian citizens/PR: EPF (KWSP), SOCSO (PERKESO), EIS, and Income Tax (PCB/LHDN) deductions will be made in accordance with Malaysian law.
6.2 For international employees holding valid work permits: EPF contributions are mandatory if monthly salary ≥ RM 5,000 (as per current law). SOCSO and EIS may apply depending on visa category.
7. Work Location & Remote Work
7.1 The primary place of work is Kuala Lumpur / Selangor, Malaysia unless otherwise stated.
7.2 Remote or hybrid arrangements may be granted at the Company’s sole discretion and can be revoked at any time.
8. Training Bond (18-Month Structured Program)
8.1 All new hires (except short-term interns) are required to undergo an 18-month structured training program.
8.2 You agree to a training bond equivalent to the cost of training incurred by the Company if you resign or are terminated for misconduct before completing 24 months of service.
8.3 Bond amount will be specified in your Employment Contract.
9. Confidentiality & Non-Disclosure
9.1 You shall not, during or after employment, disclose any confidential information, client data, trade secrets, or intellectual property of the Company or its clients.
9.2 Breach of confidentiality will result in legal action and claim for damages.
10. Non-Compete & Non-Solicitation (Post-Employment)
10.1 For a period of twelve (12) months after termination, you shall not:
(a) Directly or indirectly solicit or entice away any client or employee of the Company
(b) Engage in any competing business within Malaysia that provides similar digital transformation or technology consulting services
10.2 The Company reserves the right to seek injunctive relief for any breach.
11. Intellectual Property
All work products, code, designs, documents, or inventions created during employment belong exclusively to the Company.
12. Termination
12.1 After probation, termination requires one (1) to three (3) months’ notice (as stated in contract) or payment in lieu.
12.2 The Company may terminate without notice for gross misconduct, fraud, or serious breach of these terms.
13. Personal Data Protection (PDPA 2010 – Malaysia)
13.1 You consent to the collection, processing, and storage of your personal data for recruitment, employment, and statutory purposes.
13.2 Data may be shared with government authorities (Immigration, LHDN, KWSP, SOCSO, etc.) as required by law.
14. Visa & Work Permit (International Applicants)
14.1 The Company will assist with Employment Pass applications where applicable, but the final decision rests with the Malaysian Immigration Department.
14.2 You are responsible for maintaining valid visa status at all times.
14.3 If your work permit is rejected or revoked, employment will automatically terminate without compensation.
15. Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of Malaysia. Any dispute shall be subject to the exclusive jurisdiction of the courts of Malaysia.
16. Amendments
The Company reserves the right to amend these Terms & Conditions at any time. Continued employment after notification constitutes acceptance.
By ticking the checkbox “I have read and agree to the Terms & Conditions” on the application form, or by accepting any offer of employment, you confirm that you fully understand and accept these Terms & Conditions without reservation.
